Terms of Service

1. Service Description

ROVIK ("Remote Operated Vehicle Integration Kit") is a cloud-based drone operations management platform designed for commercial drone operators. The platform provides tools for mission planning, fleet management, compliance tracking, client relationship management, invoicing, and operational reporting.

The Service is provided by ROVIK ("Company," "we," "our," or "us") and is made available through our web application and associated APIs.

2. Account Terms

To access the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

  • You must be at least 18 years of age to use this Service.
  • You must provide a valid email address and accurate identification information.
  • You are responsible for all content posted and activity that occurs under your account.
  • You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • Company accounts may have multiple users. The account owner is responsible for the actions of all authorized users.

3. Billing and Payments

Certain features of the Service may require a paid subscription. By selecting a paid plan, you agree to pay the applicable fees as described at the time of purchase.

  • All fees are exclusive of taxes unless stated otherwise.
  • Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected.
  • Payments are processed through Stripe. By providing payment information, you authorize us to charge the applicable fees.
  • We reserve the right to modify pricing with 30 days' notice to existing subscribers.
  • Refunds are handled on a case-by-case basis at our discretion.

4. Data Ownership

You retain full ownership of all data you submit to the Service, including but not limited to mission data, flight logs, images, reports, client information, and financial records.

  • We do not claim ownership over your content or data.
  • You grant us a limited license to process, store, and display your data solely for the purpose of providing the Service.
  • You may export your data at any time through the platform's export functionality.
  • Upon account termination, your data will be retained for 30 days before permanent deletion, unless otherwise required by law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including FAA regulations for drone operations.

You agree not to:

  • Use the Service to facilitate any illegal drone operations or activities.
  • Attempt to gain unauthorized access to the Service, other users' accounts, or related systems.
  • Upload malicious software, viruses, or any code designed to interfere with the Service.
  • Use automated tools to scrape, crawl, or extract data from the Service without authorization.
  • Resell, redistribute, or sublicense access to the Service without written consent.
  • Misrepresent your identity or affiliation when using the Service.

6. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, ROVIK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service.
  • Any unauthorized access to or use of our servers and any personal information stored therein.
  • Any interruption or cessation of transmission to or from the Service.
  • Errors, inaccuracies, or omissions in any content or data made available through the Service.

ROVIK is not responsible for ensuring compliance with FAA regulations, local airspace restrictions, or any other regulatory requirements. Users are solely responsible for conducting their drone operations in compliance with all applicable laws.

7. Termination

Either party may terminate the agreement at any time. You may cancel your account through the account settings or by contacting support.

  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activities.
  • Upon termination, your right to access the Service will cease immediately.
  • We will make your data available for export for 30 days following termination.
  • Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or via email at least 30 days before they become effective. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from or related to these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules.
